Balancing rights

How can publishers and authors achieve a balance of rights, the key recommendation in the Zwolle Principles. The wording of legal agreements is important but legal terminology is not a good starting point for the majority of authors and publishers who do not have legal training. Before considering the legal language necessary to express what they are trying to achieve in publishing agreements and licences, authors and publishers need a clear understanding of the rights that are important to them. Whether or not copyright is assigned by the author to the publisher (the Zwolle Principles are neutral on this issue) the various rights need to be managed in a way that respects the interests of both author and publisher.
